1.1 Agreement to Terms
By accessing or using the website and online store at https://overallapexsupplements.ca/
(the “Site”) and purchasing products from Overall Apex Supplements (“we”, “our”, “us”),
you agree to be bound by these Terms of Use, our Privacy Policy, and any other policies
referenced here. If you do not agree, do not use the Site.
1.2 Eligibility & Age Restriction
- No sales to persons under twelve (12) years old. By placing an order you
represent and warrant that you are at least 12 years of age, or you are placing the
order on behalf of someone who is at least 12 and that you have parental/guardian
consent to do so. - Minors (persons between ages 12–17) may only purchase with the explicit consent
of a parent or legal guardian; we may require proof of parental consent and/or
identity verification before accepting or fulfilling such orders. - We reserve the right to refuse or cancel any order where we suspect the purchaser
is under 12 or lacks parental/guardian consent. If we cancel for this reason, we will
notify the purchaser and refund any payment made, subject to our Refund Policy
below.

1.3 Account Registration & Security
You are responsible for maintaining the confidentiality of account credentials and for all
activity under your account. Notify us immediately if you suspect unauthorized access.
1.4 Orders, Pricing & Payment - Orders are subject to acceptance and product availability. We reserve the right to
limit quantities. - Prices shown are in CAD unless otherwise stated and do not always include
taxes/shipping. You are responsible for any taxes, duties, or fees imposed by your
jurisdiction. - We accept payment methods displayed at checkout. Payment is processed
securely; title to goods passes to you on shipment/delivery as specified at
checkout.
1.5 Shipping & Delivery - Shipping methods, fees and times are displayed at checkout. We are not
responsible for carrier delays. Risk passes upon delivery to the carrier unless
otherwise required by law or specified at checkout.
1.6 Returns, Refunds & Cancellations - Returns: Opened dietary supplements generally cannot be accepted for sanitary
and safety reasons unless defective or mislabeled. Unopened products may be
returned within 30 days of delivery for refund or exchange subject to inspection,
shipping costs and restocking conditions. - Cancellations: Orders may be cancelled before shipment. Once shipped, returns
follow the Returns policy. - We reserve the right to refuse returns that are returned improperly or outside
timeframes.
1.7 Product Information & Medical Disclaimer - Products sold are natural health products / dietary supplements and are
intended to support general health. They are not intended to diagnose, treat, cure or
prevent any disease. Do not rely on product descriptions as medical advice.
Consult a licensed healthcare professional before using supplements, especially if
you are pregnant, nursing, have a medical condition, or take prescription
medication. - Product labels and listings contain required Health Canada information and any
applicable Natural Health Product Number (NPN) or authorization. We comply with
Health Canada’s Natural Health Products Regulations for NHPs and labelling.

1.8 Safety & Adverse Reaction Reporting
If you experience an adverse reaction to a product sold by us, stop using the product and
consult a healthcare professional immediately. You may also report adverse reactions to

1.9 Advertising & Health Claims
We will not make therapeutic claims for supplements that are not permitted by Health
Canada or that would be deceptive under the Competition Act. Our marketing complies
with Health Canada and Competition Bureau guidance on advertising health products; do

1.10 Intellectual Property
All content on the Site (text, images, logos) is owned by or licensed to us. You may not copy
or reuse Site content except for permitted personal, non-commercial use.
1.11 Limitation of Liability
To the fullest extent permitted by law, our liability for any claim related to the Site or
products is limited to the purchase price paid for the product(s) that are the subject of the
claim. We are not liable for indirect, incidental, or consequential losses.
1.12 Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities,
costs and expenses (including reasonable legal fees) arising from your breach of these
Terms or misuse of the Site.
1.13 Governing Law & Dispute Resolution
These Terms and all disputes arising from or related to them are governed by the laws of
the Province of British Columbia and the federal laws of Canada. You and we submit to
the exclusive jurisdiction of the courts of British Columbia.
1.14 Changes to Terms
We may update these Terms at any time. The “Effective date” above shows when these
Terms were last updated. Continued use constitutes acceptance of updated Terms.

2.2 What We Collect
We collect personal information necessary to provide services and process orders: name,
billing/shipping address, email, phone, payment info (via third-party processor — we do
not store full card details), age or date of birth (to enforce minimum age policy), and
purchase history. We may collect device & browser data, IP address, cookies and analytics
for Site operation.
2.3 How We Use Personal Information
We use information to: process orders, communicate order status, provide customer
service, comply with legal requirements (including age verification), prevent fraud, run
promotions, and improve services. We will seek consent where required and limit use to
identified purposes.
2.4 Legal Basis & Consent
By using our Site and providing personal data, you consent to collection, use and
disclosure as described. Where required by law, we obtain consent before collecting
sensitive information.
2.5 Sharing & Third Parties
We may share personal information with: payment processors, shipping carriers, analytics

the information. No online transmission is 100% secure — we use reputable payment
processors and TLS encryption.

You may request access to and correction of your personal data. To exercise rights or

2.10 International Transfers
If we transfer personal information outside Canada (e.g., to cloud providers), we will
require equivalent contractual protections and safeguards. - Shipping Policy (Short)
- Domestic (Canada): estimated 3–10 business days depending on service selected.
- International: shipping times and duties vary by destination. Customer is
responsible for import duties, taxes and customs clearance. - Lost/damaged shipments: report within 14 days of expected delivery; we will assist
with carrier claims.
- Returns & Refund Policy (Detailed)
- Eligibility: Unopened supplements may be returned within 30 days if in original
condition. Opened products accepted only when defective or mislabeled. - Process: To start a return contact jarethtaylor@ymail.com with order number and
reason. We may require photos or evidence. - Refund timeline: Refunds issued to original payment method within 14 business
days after receipt and inspection. Shipping fees non-refundable except in certain
circumstances.
- Safety, Labelling & Compliance
- Our products comply with the Food and Drugs Act and the Natural Health
Products Regulations; licensed products have the appropriate Natural Health
Product Number (NPN) or authorization. Product labelling meets Health Canada
requirements and includes ingredient lists, recommended use, cautions and
storage instructions. Consumers should follow label directions and consult

- Advertising, Claims & Promotions
- We comply with Health Canada and Competition Bureau guidance: advertising may
not make unauthorized therapeutic claims or mislead consumers. Promotional
contests and sweepstakes follow Competition Bureau best practices and any

- Age Verification & Minors —
Implementation Details
To implement our “no sales to anyone under 12” policy we will: - Require purchasers to enter date of birth at checkout and confirm they are at least
12 or have parental permission. - For orders where the DOB indicates a purchaser under 18, require additional
parental/guardian consent and carry out ID verification where appropriate. - Reserve the right to request government ID at delivery/pickup and to cancel orders
where we cannot verify age/consent. - Keep records and documentation of consents/verification in accordance with
privacy law and retention policies.
Important legal point: Health Canada’s Natural Health Product Regulations set safety,
labelling and licensing requirements but do not themselves create a general national
minimum purchaser age for dietary supplements; provinces can impose rules for specific
product types (and businesses may adopt stricter age limits as a protective policy). Also
ensure age-based policies are applied with regard to provincial human rights and
consumer protection rules (in BC age is defined differently within the Human Rights Code
— consult counsel if you believe your policy could intersect with human-rights
